These Terms of Service ("Terms") govern your use of the services provided by Roberts Automations, a sole proprietorship based in Austin, Texas ("Roberts Automations," "we," "us," or "our"). By purchasing, subscribing to, or using our services, you ("Client," "you") agree to these Terms. If you do not agree, do not use our services.
Roberts Automations provides marketing and communications automation services for businesses, which may include: missed-call text-back, automated review requests and review-reply drafting, lead-response automation, appointment and estimate reminders, quote follow-up, website chat, after-hours AI phone answering, customer-list reactivation campaigns, website design and hosting, and Google Business Profile setup and management (collectively, the "Services"). The specific Services you receive depend on the plan or package you purchase.
This section is important. Many Services send text messages, emails, or calls to your customers and contacts on your behalf. You represent, warrant, and agree that:
You are solely responsible for your compliance with laws governing communications to your customers. We provide the tools; you control who is contacted and on what basis.
When we handle data about your customers (such as phone numbers and names) to deliver the Services, we act as your service provider and process that data only to provide the Services to you, in accordance with our Privacy Policy and applicable law. You remain the controller of your customer data. We use reputable sub-processors (including Twilio, Stripe, and Google) to deliver the Services. We will not sell your customer data.
Upon full payment, you own the final deliverables created specifically for you (such as your website content and copy). We retain ownership of our underlying tools, templates, workflows, systems, and know-how, and may reuse these for other clients. We may reference your business name and non-confidential results as a portfolio example or testimonial unless you ask us in writing not to.
We work hard to improve your results, but we do not and cannot guarantee any specific outcome — including search rankings, Google Business Profile placement, number of leads, calls, reviews, bookings, or revenue. Results depend on many factors outside our control, including Google and platform algorithms, your market, your responsiveness, and your customers. Statements about typical results are illustrative, not promises.
The Services rely on third-party platforms (e.g., Twilio, Stripe, Google, Meta, calendar and booking tools). Your use of those platforms may be subject to their own terms, and we are not responsible for their availability, changes, outages, or actions. Fees, suspensions, or policy changes by these providers are outside our control.
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or that messages will always be delivered (carriers and platforms can delay or block messages).
To the fullest extent permitted by law, Roberts Automations will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total aggregate liability for any claim arising out of or relating to the Services will not exceed the amount you paid us for the Services in the three (3) months immediately preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless Roberts Automations from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) the content, offers, or data you provide; (c) communications sent to your customers, including any claim under the TCPA, CAN-SPAM, or similar laws based on a lack of required consent; and (d) your violation of any law or third-party right.
These Terms apply for as long as you use the Services. Either party may terminate as described in Section 3. Upon termination, your right to use the Services ends; sections that by their nature should survive (including Sections 4, 6, 7, 9, 10, 11, and 13) survive termination.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. The parties will first attempt to resolve any dispute informally by contacting each other. Any unresolved dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas, and you consent to venue there. Each party bears its own costs unless a court orders otherwise.
We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date and, for material changes affecting active subscribers, provide reasonable notice. Continued use of the Services after changes take effect constitutes acceptance.
Program name: Roberts Automations. Program description: We send customer-care text messages — including an automated acknowledgment when a call to our business line is missed, and replies to customer inquiries — only to people who have first contacted us by calling or texting our business phone number.
Message frequency varies and is conversational; messages are sent in direct response to your contact with us. Message and data rates may apply.
For help, reply HELP or email christopher@robertsautomations.com. To stop receiving messages, reply STOP at any time — you will receive one confirmation and then no further messages.
